Proposal for a Regulation of the European Parliament and of the Council on roaming on public mobile networks within the Community and amending Directive 2002/21/EC on a common regulatory framework for electronic communications networks and services De mogelijkheid voor gebruikers van mobiele elektronische communicatiediensten om met hun mobiele telefoon in het buitenland gesprekken te initiëren en te ontvangen ('internationale roaming') is een belangrijk onderdeel van de geleverde dienst en draagt bij tot de maatschappelijke en economische welvaart in de gehele Gemeenschap. De hoge tarieven die mobiele gebruikers betalen voor het gebruik van deze dienst zijn echter door consumentenorganisaties, regelgevers en beleidsmakers in de gehele Gemeenschap aangemerkt als een blijvend probleem. Hoewel in de afgelopen jaren een reeks acties is opgezet om dit probleem met gebruikmaking van de bestaande wetgeving aan te pakken, zijn de beschikbare instrumenten ontoereikend gebleken om de tarieven te verlagen naar een niveau dat de onderliggende kosten voor de desbetreffende dienstverlening weerspiegelt.

De doelstelling van dit voorstel is dan ook om het bestaande regelgevingskader voor elektronische communicatie aan te passen en zo de vereiste rechtsgrondslag tot stand te brengen voor doeltreffende en tijdige actie om op een geharmoniseerde manier het niveau van de roamingtarieven in de Gemeenschap drastisch te verlagen. Dit moet bereikt worden door het beginsel ten uitvoer te leggen dat de tarieven die door de gebruikers van openbare mobiele netwerken worden betaald voor roamingdiensten wanneer zij reizen binnen de Gemeenschap, niet ongerechtvaardigd hoger mogen liggen dan de tarieven die hen worden aangerekend wanneer zij in hun eigen land telefoneren (de 'Europese-thuismarktaanpak').

Het mechanisme waarvoor gekozen is om deze doelstelling op een evenredige wijze te bereiken, is de invoering voor de exploitanten van terrestrische mobiele netwerken van maximumtarieven voor de levering van roamingdiensten voor gesprekken tussen de lidstaten op zowel retail- als wholesale-niveau.

De Nederlandse gebruikers van roamingdiensten hebben baat bij de lagere tarieven. Daarom heeft Nederland in het verleden ook aangedrongen op de totstandkoming van deze verordening. De verordening grijpt in op de goede punten (zoals te hoge tarieven die de aanbieders elkaar in rekening brengen en vervolgens doorberekenen aan de consumenten), en kan snel en effectief een einde maken aan de al vele jaren uitzonderlijk hoge roamingtarieven.

Deze regulation is gebaseerd op EG-Verdrag artikel 95. Artikel 95 maakt onderdeel uit van het hoofdstuk 'Aanpassing van de wetgevingen' van het EG-Verdrag. Het heeft betrekking op instelling en werking van de interne markt.
